ARTICLE I
NAME

The name of this organization shall be Public Utility Employees of the City of Detroit, Michigan, Local 207, of the American Federation of State, County and Municipal Employees,
AFL-CIO.



ARTICLE II
AFFILIATIONS


This local union shall be affiliated with Michigan Council Number 25 of the American Federation of State, County and Municipal Employees; the Michigan State AFL-CIO; and the Metropolitan Detroit AFL-CIO.



ARTICLE III
OBJECTIVES


The objectives of this local union shall be to carry out on a local basis the objectives of the American Federation of State, County and Municipal Employees.

A. To promote the organization of workers in general and public employees in particular.

B. To promote the welfare of the membership and to provide a voice in the determination of the terms and conditions of employment. We are committed to the process of collective bargaining as the most desirable, democratic and effective method to achieve this. Both as Union members and as citizens, we shall also employ available legislative and political action.

C. To cooperate with other labor organizations in particular and other segments of our society in general toward the end that the material riches of American society be more justly distributed and the moral promise of American Life be realized.



ARTICLE IV
MEMBERSHIP AND DUES

Section 1. Employees of the Detroit, Michigan Metro Water Department and the Detroit, Michigan Public Lighting Department, excluding those employees within the jurisdiction of Local 2920 are eligible for membership in this local union subject to the requirement of the International Constitution.


Section 2. Application for membership shall be made on a standard application and check-off form. Unless such form includes a valid authorization for payroll deduction of dues, the application shall be accompanied by the current month's dues.

Section 3. The biweekly membership dues of the local shall be one (1) hour's pay per member.

Section 4. Membership dues shall be payable monthly in advance to the local secretary-treasurer and in any event shall be paid no later than the 15th day of the month in which they become due. Any member who fails to pay dues by the 15th day of the month in which they become due shall be considered delinquent, and upon a failure to pay dues for two successive months shall stand suspended. Provided, however, that any person who is paying his dues through a system of regular payroll deduction shall, for so long as he continues to pay through such deduction method, be considered in good standing.

Section 5. A member suspended under the above section may be reinstated to membership in the local on payment of all arrearage or upon payment of a reinstatement fee of $5.00 plus the current months dues.



ARTICLE V
MEETINGS


Section 1.  Regular general local meetings shall be held monthly at a time and place to be fixed by the local executive board.

Section 2.  Special general local membership meetings may be called by the president, a majority of the executive board, or by a petition filed with the president signed by one-tenth of the members.  Special general local membership meetings may also be called by the International president or his authorized representative.


Section 3. The local union executive board shall meet monthly at a time and place to be fixed by the members of the executive board. A majority of the board members will constitute a quorum.

Section 4. Special meetings of the local executive board may be called by the president, or a majority of the executive board. A special meeting of the executive board may also be called by the International President or his authorized representative.

Section 5. Meetings of the units will be held bimonthly. The unit meetings will be held in the months of February, April, June, August, October and December.


Section 6. Special meetings of a unit may be called by the local union president, the local union executive board, the chairperson of the unit, or by petition filed with the president of the local and signed by one-quarter of the members of the unit. Special meetings of a unit may be called by the International President or his authorized representative.

Section 7. The quorum for meetings of this local shall be four and one-half percent (4.5%) of the membership in good standing.



ARTICLE VI
LOCAL UNION OFFICERS, 
EXECUTIVE BOARD, AND TRUSTEES


Section 1. The officers of the local shall be a president, vice-president, recording secretary, secretary-treasurer and sergeant-at-arms.

Section 2. The executive board members shall be the president, vice-president, recording secretary, secretary-treasurer and sergeant-at-arms. In addition, the unit chairperson from the general unit, public lighting unit and operator's unit, who, by virtue of their offices, shall serve with the above officers as executive board members.

Section 3. There shall be elected three members who shall serve as trustees. These trustees will be elected in accordance with Article VII in the local constitution, governing the election of local union officers.



ARTICLE VII
NOMINATIONS AND ELECTIONS


Section 1. Nominations of and elections of officers of this local shall be held every three (3) years, beginning in the year of 1979.

Section 2. Beginning with the year of 1971, nominations of officers of this local shall be conducted in October at the general membership meeting.

Section 3. At least fifteen (15) days advance notice shall be given the general membership that nominations will be held.

Section 4. The general membership shall be given at least fifteen (15) days notice of elections.

Section 5. Nominations and elections of unit officers shall be held every three (3) years, at the time of the local's officers election, beginning in 1988.

Section 6. At least fifteen (15) days advance notice shall be given the unit membership that nominations and elections will be held.

Section 7. To be eligible for office, a member must be in good standing for one (1) year immediately preceding the date of nomination.

Section 8.  Election shall be conducted on a weekday, on the day immediately prior to the November regular local general membership meeting.  Voting shall be conducted between the hours of six (6) a.m. and six (6) p.m. at the union hall.  Voting shall be conducted by walk-in secret ballot voting.  The election committee shall report the election results to the November regular local general membership meeting.

Section 9. All matters concerning nominations and elections shall be subject to the provisions of Appendix D, entitled Elections Code, of the International Constitution, and which is a part of the Constitution by reference.

Section 10. Vacancies in the office of vice-president, recording secretary, secretary-treasurer or sergeant-at-arms shall be filled for the remainder of the unexpired term by a vote of the executive board. In the event the office of president falls vacant, the vice-president shall become president for the remainder of the unexpired term, and the office of vice-president shall be filled for the remainder of the unexpired term by vote of the executive board.

Section 11. In the event the office of unit chairperson falls vacant, the unexpired term will be completed by the vice-chairperson. Vacancy in the office of unit vice-chairperson shall be filled for the remainder of the unexpired term by a majority vote of the unit members present at a regular or special meeting.

Section 12. In the event that an executive board member is elected to fill a vacancy in the office of the vice-president, recording secretary or secretary-treasurer and accepts such election, he shall resign his position in the unit, and such vacated office shall be filled by a vote of the unit membership.

Section 13. Except for those elected to the executive board of this local union by virtue of their election in the unit, no member may hold two offices concurrently.

Section 14. Every officer shall, upon assuming office, subscribe to the Obligation of an Officer, contained in Appendix B of the International Constitution, which is made a part of this constitution by reference.



ARTICLE VIII
DUTIES OF OFFICERS, 
EXECUTIVE BOARD, AND TRUSTEES

Section 1. The president of the union shall preside at all general membership meetings of this local union and of the local executive board. He shall be an ex-officio member of all local union committees. He shall appoint all standing committees and all special committees of the local, subject to the approval of the executive board. He shall report at least monthly as long as meetings are in session, the progress and standing of the local union to the membership regarding his official acts.

Section 2. The vice-president of this local union shall assist the president in the work of his office. In the absence of the president or in his inability to serve, the vice-president shall preside at all meetings and perform all duties otherwise performed by the president. He may, with the approval of the executive board, be authorized to act as cosigner of checks drawn on the local funds in place of either the president or the secretary-treasurer.

Section 3. The recording secretary of this union shall keep a record of the proceedings. He shall carry on the official correspondence of the local, except as the executive board may direct otherwise. He shall perform such other duties as the executive board may require. A copy of the minutes of all meetings will be given to the president and secretary-treasurer.

Section 4. The secretary-treasurer of this union shall receive and receipt for all monies of the local union. He shall deposit all money so received in the name of the local union in a bank or banks insured by the Federal Deposit Insurance Corporation, in an amount not exceeding insured amount, and money so deposited shall be withdrawn only by check signed by the president and the secretary-treasurer or such other authorized officers of the local union for purposes only as are required by the constitution or are authorized by the membership or the executive board. He shall prepare and submit the monthly membership report to the International Union office, and thereon shall certify that it is accurate. On or before March 1, of each year, he shall submit to the International Secretary-Treasurer a statement of assets handled by the local during the previous calendar year on forms to be supplied by the International Secretary-Treasurer. He shall keep an accurate record of receipts and disbursements and shall, once each month, submit to the executive board a monthly operating statement of the financial transactions of the local for the previous month. He shall provide a quarterly printed report to the general membership at its regular meetings. He shall be responsible for transferring to his successor in office all financial records, retention of which is required by Article IX, of the International Constitution. He shall act as custodian of all properties of the local union.

Section 5. The trustees of this union shall make or cause to be made at least semiannually an audit of the local?s finances, and shall report to the membership on the results of such audit, and perform such other duties as may be prescribed in the International Constitution.

Section 6. The executive board of this union shall be the governing body of the local union, except when regular or special meetings of the local union are in session. All matters affecting the policies, aims, and means of accomplishing the purpose of the local not specifically provided for in this constitution or by action of the membership shall be decided by thee executive board. A report on all actions taken by the executive board shall be made to the membership, for approval of the membership, at the following meeting of the local. A majority of the members of the executive board shall be required for a quorum.

Section 7. The unit chairperson shall assist all stewards and unit members with concerns, other than grievances, that may arise in his/her unit. The chairperson shall schedule bimonthly unit meetings and shall present to the local president all unit minutes. The unit chairperson shall submit quarterly steward activity reports for steward allowance and expenses of unit members. The unit chairperson shall request steward training classes for the stewards in his/her unit annually.

Section 8. Sergeant-at-arms duties shall be governed by Robert's Rules of Order, Revised, assisting in preserving order as the chair may direct.



ARTICLE IX
UNITS


Section 1. There shall be the following units in this local: Detroit Water and Sewerage General; Detroit Water and Sewerage Operators; Public Lighting Department General.

Detroit Water and Sewerage General Unit - Includes all Water and Sewerage bargaining unit classifications, excluding operators unit titles.

Detroit Water and Sewerage Operators Unit -
Water Plant Attendant Grade-I Water System Control Operator
Water Plant Attendant Grade-II Sewage Plant Helper
Water Plant Operator Apprentice Sewage Plant Attendant
Water Plant Operator Sewage Plant Operator
Senior Water Plant Operator Senior Sewage Plant Operator

Public Lighting Department, PLD General Unit - All Public Lighting classifications represented by Local 207.

Section 2. The officers of each unit shall be a unit chairperson, vice-chairperson and a unit secretary and shall be elected in accordance with the provisions of this constitution. The unit officers shall be elected for a three (3) year term, by the unit members.

Section 3. The members of the local unit shall vote and pass on all matters and terms of unit contracts and agreements entered into or negotiated on their behalf.

Section 4. There may be formed, on the recommendation of the executive board and with the consent of the membership and the approval of the International Union, such new units as are deemed necessary and proper.



ARTICLE X
STEWARDS


Section 1. Stewards shall be elected for a two-year (2) terms in the even numbered years. They shall be elected by unit and by majority vote of the members from his/her location.

Section 2. Stewards? and alternates? absence must be reported to the unit chairperson through the local union office.

Section 3. Stewards and alternates absent 90 days shall be replaced by appointment of the president.


Section 4. Stewards are to report any problem, other than grievances to the unit chairperson through the local office.

Section 5. Stewards must submit a steward report with all grievances and suspensions.

Section 6. Stewards must submit all disciplines and grievances to the local's office immediately upon notification.

Section 7. To be eligible for a steward position in this local, a member must be in good standing for one (1) year immediately preceding the date of nomination for stewards.



ARTICLE XI
MISCELLANEOUS PROVISIONS


Section 1. This local union shall at all times be subject to the provisions of the Constitution of the American Federation of State, County and Municipal Employees, AFL-CIO and the provisions of the Constitution of Council Number 25, AFSCME, AFL-CIO.

Section 2. Except to extent specified in this Constitution, no officer of the local union shall have the power to act as agent for or otherwise bind the local in any way whatsoever. No member or group of members or other person or persons shall have the power to act on behalf of or otherwise bind the local union except to the extent specifically authorized in writing by the president of the local or by the executive board of the local union.

Section 3. Robert's Rules of Order, Revised shall be the guide in all cases in which they are applicable and in which they are not inconsistent with the Constitution or special rules of this local union or of the American Federation of State, County and Municipal Employees.

Section 4. All judicial procedure shall be conducted in accordance with Article X of the International Constitution.

Section 5. All members of this local shall receive a copy of the Constitution governing this local and of any amendments which may be adopted at any later time.

Section 6. The local president, by virtue of being elected to the office of president, shall be a delegate to all International, council, state and central body conventions, and shall be designated as delegate chairperson.

Section 7. All officers and employees shall be bonded in the amount of ten-percent (10%) of the assets handled annually by the local, as per Article IX, of the International Constitution.



ARTICLE XII
AMENDMENTS



Section 1. This Constitution may be amended, revised, or otherwise changed only by a vote of two-thirds of the members voting on such proposed change; and such amendment, revision, or change shall take effect only upon written approval of the International President.

Section 2. Proposed amendments, revisions, or changes to this Constitution must be read at a regular or special meeting of the local, providing adequate and proper notice has been given to all members prior to the date on which the vote is taken.
